This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. The domain name www.ezwed.in (hereinafter referred to as "Website") is owned by Ezwoks Internet Private Limited a company incorporated under the Companies Act, 1956 with its registered office at No. 6/279, Thyagaraja Nagar, Woraiyur, Trichy- 620003, Tamil Nadu , India (hereinafter referred to as "Ezwoks").
THE SITE, APPLICATION AND SERVICES COMPRISE AN ONLINE PLATFORM THROUGH WHICH VENDORS (DEFINED BELOW) MAY CREATE LISTINGS (DEFINED BELOW) FOR SERVICES (DEFINED BELOW) AND CUSTOMERS (DEFINED BELOW) MAY LEARN ABOUT AND BOOK DIRECTLY WITH THE VENDORS. YOU UNDERSTAND AND AGREE THAT EZWOKS IS NOT A PARTY TO ANY AGREEMENTS ENTERED INTO BETWEEN VENDORS AND CUSTOMERS, NOR IS EZWOKS A WEDDING PLANNER, AGENT OR INSURER. EZWOKS HAS NO CONTROL OVER THE CONDUCT OF VENDORS, CUSTOMERS AND OTHER USERS OF THE SITE, APPLICATION AND SERVICES OR ANY SERVICES, AND DISCLAIMS ALL LIABILITY IN THIS REGARD TO THE MAXIMUM EXTENT PERMITTED BY LAW.
"Ezwoks Content" means all Content that Ezwoks makes available through the Site, Application, or Services, including any Content licensed from a third party, but excluding Member Content.
"Booking Request Period" means the time period starting from the time when a booking is requested by a Customer (as determined by Ezwoks in its sole discretion), within which a Vendor may decide whether to confirm or reject that booking request, as stated on the Site, Application or Services. Different Booking Request Periods may apply in different places.
"Collective Content" means Member Content and Ezwoks Content.
"Content" means text, graphics, images, music, software (excluding the Application), audio, video, information or other materials.
"Customer" means a Member who requests from a Vendor a booking of a Service or Property or purchase of product via the Site, Application or Services, or a Member who utilizes an Service.
"Vendor" means a Member who creates a Listing via the Site, Application and Services.
"Service" means a Service or product that is listed by a Vendor as available for offer via the Site and Application.
"Subscription" means a booking of a service listed by a Vendor in the Website.
"Member" means a person who completes Ezwoks's account registration process, including but not limited to Vendors and Customers, as described under "Account Registration" below.
"Member Content" means all Content that a Member posts, uploads, publishes, submits or transmits to be made available through the Site, Application or Services.
"Tax" or "Taxes" mean any sales taxes, value added taxes (VAT), goods and services taxes (GST), transient occupancy taxes, tourist or other visitor taxes, accommodation or lodging taxes, fees (such as convention center fees) that accommodation providers may be required by law to collect and remit to governmental agencies, and other similar municipal, state, federal and national indirect or other withholding and personal or corporate income taxes.
Certain areas of the Site and Application (and your access to or use of certain aspects of the Services or Collective Content) may have different terms and conditions posted or may require you to agree with and accept additional terms and conditions. If there is a conflict between these Terms and terms and conditions posted for a specific area of the Site, Application, Services, or Collective Content, the latter terms and conditions will take precedence with respect to your use of or access to that area of the Site, Application, Services, or Collective Content.
YOU ACKNOWLEDGE AND AGREE THAT, BY ACCESSING OR USING THE SITE, APPLICATION OR SERVICES OR BY DOWNLOADING OR POSTING ANY CONTENT FROM OR ON THE SITE, VIA THE APPLICATION OR THROUGH THE SERVICES, OR BY PARTICIPATING IN THE REFERRAL PROGRAM, YOU ARE INDICATING THAT YOU HAVE READ, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS, WHETHER OR NOT YOU HAVE REGISTERED WITH THE SITE AND APPLICATION. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE, APPLICATION, SERVICES, OR COLLECTIVE CONTENT OR TO PARTICIPATE IN THE REFERRAL PROGRAM. If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, "you" and "your" will refer and apply to that company or other legal entity.
How the Site, Application and Services Work
The Site, Application and Services can be used to facilitate the listing and booking of wedding halls and other properties ( hereinafter reffered as "Property") and products and services related to wedding. Such Propertys are included in Listings on the Site, Application and Services by Vendors. You may view Listings as an unregistered visitor to the Site, Application and Services; however, if you wish to book a Property or service or create a Listing, you must first register to create an Ezwoks Account (defined below).
As stated above, Ezwoks makes available an online platform or marketplace with related technology for Customers and Vendors to meet online and arrange for bookings of Properties or services and purchase of products directly with each other. Ezwoks is not an owner or operator of properties, including, but not limited to, Banquet halls, wedding halls, other lodgings or Properties, nor is it a provider of properties, including, but not limited to, Banquet halls, wedding halls, other properties and Ezwoks does not own, sell, resell, furnish, provide, rent, re-rent, manage and/or control properties, including, but not limited to, Banquet halls, wedding halls, other lodgings or Propertys or transportation or travel services. Unless explicitly specified otherwise in the Ezwoks platform, Ezwoks's responsibilities are limited to: (i) facilitating the availability of the Site, Application and Services and (ii) serving as the limited payment collection agent of each Vendor for the purpose of accepting payments from Customers on behalf of the Vendor.
PLEASE NOTE THAT, AS STATED ABOVE, THE SITE, APPLICATION AND SERVICES ARE INTENDED TO BE USED TO FACILITATE VENDORS AND CUSTOMERS CONNECTING AND BOOKING PROPERTIES OR SERVICE AND PURCHASE OF PRODUCTS DIRECTLY WITH EACH OTHER. EZWOKS CANNOT AND DOES NOT CONTROL THE CONTENT CONTAINED IN ANY LISTINGS AND THE CONDITION, LEGALITY OR SUITABILITY OF ANY PROPERTY, PRODUCT OR SERVICE. EZWOKS IS NOT RESPONSIBLE FOR AND DISCLAIMS ANY AND ALL LIABILITY RELATED TO ANY AND ALL LISTINGS AND PROPERTIES. ACCORDINGLY, ANY BOOKINGS WILL BE MADE AT THE CUSTOMER'S OWN RISK.
In order to access certain features of the Site and Application, and to book an Property or Service or create a Listing, you must register to create an account ("Ezwoks Account") and become a Member. You may register to join the Services directly via the Site or Application or as described in this section.
You can also register to join by logging into your account with certain third-party social networking sites ("SNS") (including, but not limited to, Facebook; each such account, a "Third-Party Account"), via our Site or Application, as described below. As part of the functionality of the Site, Application and Services, you may link your Ezwoks Account with Third-Party Accounts, by either: (i) providing your Third-Party Account login information to Ezwoks through the Site, Services or Application; or (ii) allowing Ezwoks to access your Third-Party Account, as permitted under the applicable terms and conditions that govern your use of each Third-Party Account. You represent that you are entitled to disclose your Third-Party Account login information to Ezwoks and/or grant Ezwoks access to your Third-Party Account (including, but not limited to, for use for the purposes described herein), without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account and without obligating Ezwoks to pay any fees or making Ezwoks subject to any usage limitations imposed by such third-party service providers. By granting Ezwoks access to any Third-Party Accounts, you understand that Ezwoks will access, make available and store (if applicable) any Content that you have provided to and stored in your Third-Party Account ("SNS Content") so that it is available on and through the Site, Services and Application via your Ezwoks Account and Ezwoks Account profile page. Unless otherwise specified in these Terms, all SNS Content, if any, will be considered to be Member Content for all purposes of these Terms. Depending on the Third-Party Accounts you choose and subject to the privacy settings that you have set in such Third-Party Accounts, personally identifiable information that you post to your Third-Party Accounts will be available on and through your Ezwoks Account on the Site, Services and Application. Please note that if a Third-Party Account or associated service becomes unavailable or Ezwoks's access to such Third-Party Account is terminated by the third-party service provider, then SNS Content will no longer be available on and through the Site, Services and Application. You have the ability to disable the connection between your Ezwoks Account and your Third-Party Accounts, at any time, by accessing the "Settings" section of the Site and Application. PLEASE NOTE THAT YOUR RELATIONSHIP WITH THE THIRD-PARTY SERVICE PROVIDERS ASSOCIATED WITH YOUR THIRD-PARTY ACCOUNTS IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH THIRD-PARTY SERVICE PROVIDERS. Ezwoks makes no effort to review any SNS Content for any purpose, including but not limited to for accuracy, legality or non-infringement and Ezwoks is not responsible for any SNS Content.
We will create your Ezwoks Account and your Ezwoks Account profile page for your use of the Site and Application based upon the personal information you provide to us or that we obtain via an SNS as described above. You may not have more than one (1) active Ezwoks Account. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. Ezwoks reserves the right to suspend or terminate your Ezwoks Account and your access to the Site, Application and Services if you create more than one (1) Ezwoks Account or if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete. You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Ezwoks Account, whether or not you have authorized such activities or actions. You will immediately notify Ezwoks of any unauthorized use of your Ezwoks Account.
Properties or Services Listings
As a Member, you may create Listings. To create a Listing, you will be asked a variety of questions about the Property or Service or Product to be listed, including, but not limited to, the location, capacity, size, features, and availability of the Property and pricing and related rules and financial terms. In order to be featured in Listings via the Site, Application and Services, all Properties must have valid physical addresses. Listings will be made publicly available via the Site, Application and Services. Other Members will be able to book your Property via the Site, Application and Services based upon the information provided in your Listing. You understand and agree that once a Customer requests a booking of your Property or service, you may not request the Customer to pay a higher price than in the booking request.
Ezwoks does not endorse any Member or any Property. You understand that Verified Images are intended only to indicate a photographic representation of the Property or service or product at the time the photograph was taken. Verified Images are therefore not an endorsement by Ezwoks of any Member or any Property. Members are required by these Terms to provide accurate information, and although Ezwoks may undertake additional checks and processes designed to help verify or check the identities or backgrounds of users, we do not make any representations about, confirm, or endorse any Member or the Member's purported identity or background.
Any references in the Site, Application or Services to a Member being "featured" only indicate that the Member has completed a relevant verification process, and does not represent anything else. Any such description is not an endorsement, certification or guarantee by Ezwoks about any Member, including of the Member's identity and whether the Member is trustworthy, safe or suitable. Instead, any such description is intended to be useful information for you to evaluate when you make your own decisions about the identity and suitability of others whom you contact or interact with via the Site, Application and Services. We therefore recommend that you always exercise due diligence and care when deciding whether to stay with a Vendor or to accept a booking request from a Customer, or to have any other interaction with any other Member. We are not responsible for any damage or harm resulting from your interactions with other Members.
By using the Site, Application or Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Members or other third parties will be limited to a claim against the particular Members or other third parties who caused you harm. You agree not to attempt to impose liability on or seek any legal remedy from Ezwoks with respect to such actions or omissions. Accordingly, we encourage you to communicate directly with other Members on the Site and Services regarding any bookings or Listings made by you. This limitation shall not apply to any claim by a Vendor against Ezwoks regarding the remittance of payments received from a Customer by Ezwoks on behalf of a Vendor, which instead shall be subject to the limitations described in the section below entitled "Limitation of Liability".
Bookings and Financial Terms
"Advance fees" means the amounts that are payable by a customer to confirm booking of a Listing or Service. The Vendor alone, and not Ezwoks, determines these amounts. The " Advance Fees" is.
"Service Fees" means the fee that Ezwoks charges a Vendor for the use of its online platform, which is calculated as a percentage of the applicable "Total Fees". The Vendor Fees will be displayed to the Vendor when the Customer pays "Advance Fees".
"Term Fees" means the amounts that are due and payable by a Customer in exchange for that Customer's use of a Property or a service which is "Total Fees" â€“ "Advance Fees". The Vendor alone, and not Ezwoks, determines these amounts. The Vendor may in his or her sole discretion decide to include in these amounts, but not limited to, (i) a cleaning fee or any other fee permitted on the Ezwoks platform, or (ii) Taxes that the Vendor determines that he or she has to collect.
"Total Fees" is a collective from of "Advance Fees" and "Vendor Fees". The Vendor may in his or her sole discretion decide to include in these amounts, but not limited to, (i) a cleaning fee or any other fee permitted on the Ezwoks platform, or (ii) Taxes that the Vendor determines that he or she has to collect.
"Vendor Fees" is a collective from of "Advance fees" less "Service fees" plus "Term fees"
Bookings and Financial Terms for Vendors
If you are a Vendor and a booking is requested for your Property or service via the Site, Application and Services, by means of payment of "Advance Fees" you will be required to provide the property for use or the service for the requested period unconditionally; failing to comply with same would imply the imposition of penalty, which would be a percentage of "Total fees" and decided by Ezwoks. When a booking is requested via the Site, Application and Services, we will share with you (i) the first and last name of the Customer who has requested the booking, (ii) a link to the Customer's Ezwoks Account profile page, (iii) the names of any members of an SNS with whom you are "friends" or associated on the SNS if such individuals are also "friends" or associated with the Customer on such SNS, and (iv) an indication that the name that the Customer provided to Ezwoks when the Customer became a Member matches the name that the Customer provided to the SNSs to which the Customer has linked his or her Ezwoks Account.
Ezwoks will collect the Advance Fees at the time of booking of property or Service (i.e. when the Customer makes the Advance Fees) and will initiate payment of the same to the Vendor and an acknowledgement of receipt of the Advance Fees to the Customer. The service agreement will be complied by the Vendor only on receipt of Term Fees. The payment of Advance fees merely confirms the booking of a particular vendor by a customer for a specified time as per the availability of the vendor.
All subscriptions and other customer lead in ezwed.in are NON refundable and are NON transferable under any and all conditions.
The time it takes for the Vendor to receive payouts may depend upon the method for issuing payouts as decided by Ezwoks from time to time. Some methods involve the use of third-party payment processors, who may impose their own additional charges for the use of their services on the Vendor, including by deducting their charges from the payout amount.
Each Vendor hereby appoints Ezwoks as the Vendor's limited payment collection agent solely for the purpose of accepting the Advance Fees and Vendor Fees from Customers.
Each Vendor agrees that payment made by a Customer to Ezwoks, shall be considered the same as a payment made directly to the Vendor, and the Vendor will make the Property or service or product available to the Customer in the agreed-upon manner as if the Vendor has received the Property Fees. Each Vendor understands that as Ezwoks Payments accepts payments from Customers as the Vendor's limited payment collection agent and that Ezwoks Payments' obligation to pay the Vendor is subject to and conditional upon successful receipt of the associated payments from Customers. Ezwoks does not guarantee payments to Vendors for amounts that have not been successfully received by Ezwoks from Customers. In accepting appointment as the limited authorized agent of the Vendor, Ezwoks Payments assumes no liability for any acts or omissions of the Vendor.
Please note that Ezwoks does not currently charge fees for the creation of Listings. However, you as a Vendor acknowledge and agree that Ezwoks reserves the right, in its sole discretion, to charge you for and collect fees from you for the creation of Listings. Please note that Ezwoks will provide notice of any Listing fee collection via the Site, Application and Services, prior to implementing such a Listing fee feature.
Bookings and Financial Terms for Customers
The Vendors, not Ezwoks, are solely responsible for honoring any confirmed bookings and making available any Properties or services or product reserved through the Site, Application and Services. If you, as a Customer, choose to enter into a transaction with a Vendor for the booking of an Property or service, you agree and understand that you will be required to enter into an agreement with the Vendor and you agree to accept any terms, conditions, rules and restrictions associated with such Property or service imposed by the Vendor. You acknowledge and agree that you, and not Ezwoks, will be responsible for performing the obligations of any such agreements, that Ezwoks is not a party to such agreements, and that, with the exception of its payment obligations hereunder, Ezwoks disclaims all liability arising from or related to any such agreements. You acknowledge and agree that, notwithstanding the fact that Ezwoks is not a party to the agreement between you and the Vendor, Ezwoks acts as the Vendor's payment collection agent for the limited purpose of accepting payments from you on behalf of the Vendor. Upon your payment of the Total Fees to Ezwoks, your payment obligation to the Vendor for the Property Fees is extinguished, and Ezwoks Payments is responsible for remitting the
The Total Fees payable will be displayed to a Customer before the Customer sends a booking request to a Vendor. As noted above, the Vendor is obligated to confirm the booking request by a customer on receipt of Advance fees made by a Customer by Ezwoks, otherwise the requested vendor will be penalized for non-conformity. If a requested booking is cancelled by the vendor, any amounts collected by Ezwoks will be refunded to such Customer, depending on the selections the Customer makes via the Site and Application, and any pre-authorization of such Customer's credit card will be released, if applicable.
You as a Customer agree to pay Ezwoks for the Total Fees for any booking requested in connection with requirement from a Vendor.
General Booking and Financial Terms
Cancellations and Refunds
All subscriptions and other customer lead ezwed.in are NON refundable and are NON transferable under any and all conditions.
Ezwoks may, in its sole discretion, round up or round down amounts that are payable from or to Customers or Vendors to the nearest whole functional base unit in for INR; for example, Ezwoks will round up an amount of INR 99.89 to INR 100.00, and INR 99.49 to INR 100.00.
Payment Processing Errors
We will take steps to rectify any payment processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the same payment method used for the original payout to or payment by you, so that you end up receiving or paying the correct amount.
Ezwoks reserves the right, at its sole discretion, to modify the Site, Application or Services or to modify these Terms, including the Service Fees, at any time and without prior notice. If we modify these Terms, we will post the modification on the Site or via the Application or provide you with notice of the modification. We will also update the "Last Updated Date" at the top of these Terms. By continuing to access or use the Site, Application or Services after we have posted a modification on the Site or via the Application or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site, Application and Services.
Use of the Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the Website. If you are a minor i.e. under the age of 18 years, you shall not register as a User of the Ezwoks website and shall not transact on or use the website. As a minor if you wish to use or transact on website, such use or transaction may be made by your legal guardian or parents on the Website. Ezwoks reserves the right to terminate your membership and / or refuse to provide you with access to the Website if it is brought to Ezwoks's notice or if it is discovered that you are under the age of 18 years.
Your Account and Registration Obligations
When You use the Website or send emails or other data, information or communication to us, You agree and understand that You are communicating with Us through electronic records and You consent to receive communications via electronic records from Us periodically and as and when required. We may communicate with you by email or by such other mode of communication, electronic or otherwise.
Platform for Transaction and Communication
The Website is a platform that Users utilize to meet and interact with one another for their transactions. Ezwoks is not and cannot be a party to or control in any manner any transaction between the Website's Users.
Membership on the Website is free for Customers. Ezwoks does not charge any fee for browsing and buying on the Website. Ezwoks reserves the right to change its Fee Policy from time to time. In particular, Ezwoks may at its sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event Ezwoks reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy shall be posted on the Website and such changes shall automatically become effective immediately after they are posted on the Website. Unless otherwise stated, all fees shall be quoted in Indian Rupees. You shall be solely responsible for compliance of all applicable laws including those in India for making payments to Ezwoks Internet Private Limited.
Use of the Website
You agree, undertake and confirm that Your use of Website shall be strictly governed by the following binding principles:
Contents Posted on Site
You may use information on the products and services purposely made available on the Website for downloading, provided that You (1) do not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) do not make any additional representations or warranties relating to such documents.
Disclaimer of Warranties and Liability
This Website, all the materials and products (including but not limited to software) and services, included on or otherwise made available to You through this site are provided on "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, Ezwoks does not warrant that:

Ezwoks will not be liable to You in any way or in relation to the Contents of, or use of, or otherwise in connection with, the Website. Ezwoks does not warrant that this site; information, Content, materials, product (including software) or services included on or otherwise made available to You through the Website; their servers; or electronic communication sent from Us are free of viruses or other harmful components.
Nothing on Website constitutes, or is meant to constitute, advice of any kind. All the Products or Services sold on Website are governed by different state laws and if Vendor is unable to deliver such Products or Services due to implications of different state laws, Vendor will return or will give credit for the amount (if any) received in advance by Vendor from the sale of such Product that could not be delivered to You.
You will be required to enter a valid phone number while placing an order on the Website. By registering Your phone number with us, You consent to be contacted by Us via phone calls and/or SMS notifications, in case of any order or shipment or delivery related updates. We will not use your personal information to initiate any promotional phone calls or SMS.
The listing description of the item must not be misleading and must describe actual condition of the product. If the item description does not match the actual condition of the item, you agree to refund any amounts that you may have received from the Customer. You agree not to list a single product in multiple quantities across various categories on the Website. Ezwoks reserves the right to delete such multiple listings of the same product listed by you in various categories.
While availing any of the payment method/s available on the Website, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:
All payments made against the purchases/services on Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Website.
Before shipping / delivering your order to you, Vendor may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users.
On Clothing, Footwear and Jewellery, qualified Vendors accept 30 day exchange subject to the following conditions:
Clothes and footwear are not used (other than for trial), altered, washed, soiled or damaged in any way. Original tags and packaging should be intact. For items that come in branded packaging, the box should be undamaged.'Made to order' jewellery, Innerwear, lingerie, socks and clothing freebies are not covered under the return policy. Damaged or defective clothing and footwear products are meanwhile covered by the 30 Day Replacement Guarantee.
If Ezwoks has suspicion or knowledge, that any of its Customers and Vendors are involved in any activity that is intended to provide claims or information that is false, misleading or not genuine, then Ezwoks may while reserving its rights to initiate civil and/or criminal proceedings against member may also at its sole discretion suspend, block, restrict, cancel the Display Name of such Customer and Vendor and /or disqualify that user and any related users from availing protection through this program.
Ezwoks reserves its right to initiate civil and/or criminal proceedings against a user who, files a invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, Ezwoks may at its sole discretion suspend, block, restrict, cancel the Display Name [and its related Display Names] of such user and/or disqualify that user and any related users from availing protection through this program. Any people who, knowingly and with intent to injure, defrauds or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law.
Jurisdictional Issues/Sale in India Only

The Replacement Guarantee seeks to assist Customers who have been defrauded by qualified Vendors on the Website. If at the time of delivery and/or within specified days from the date of delivery of the product/s, if any defect is found, then the Customer of the product/s can ask for replacement of the product/s from the Vendor.
If Ezwoks has suspicion or knowledge, that any of its Customers and Vendors are involved in any activity that is intended to provide claims or information that is false, misleading or not genuine, then Ezwoks may while reserving its rights to initiate civil and/or criminal proceedings against User may also at its sole discretion suspend, block, restrict, cancel the Display Name of such Customer and Vendor and /or disqualify that User and any related Users from availing protection through this program.
Ezwoks reserves its right to initiate civil and/or criminal proceedings against a User who, files a invalid and/or false claims or provides false, incomplete, or misleading information. In addition to the legal proceedings as aforesaid, Ezwoks may at its sole discretion suspend, block, restrict, cancel the Display Name [and its related Display Names] of such User and/or disqualify that User and any related Users from availing protection through this program. Definition: 'Return' is defined as the action of giving back the item purchased by the Customer to the Vendor on the Ezwoks website. Following situations may arise:

We encourage the Customer to review the listing before making the purchase decision. In case Customer orders a wrong item, Customer shall not be entitled to anyreturn/refund.

In the event the Vendor accepts the return request raised by the Customer, Customer will have to return the product and then the refund shall be credited to the Customer's account.
In case the Vendor doesn't close the ticket in 3 days from the date of intimation to the Vendor about the refund request, the refund request shall be settled in favor of the Customer.
Further for returns being made by Customer to the Vendor of the product, the following parameters needs to be ensured by the Customer:

Definition: Replacement is the action or process of replacing something in place of another. A Customer can request for replacement whenever he is not happy with the item, reason being Damaged in shipping, Defective item, Item(s) missing, wrong item shipped and the like.
Points to be noted:
Customer need to raise the replacement request within 10 days from the date of delivery of products. Once Customer has raised a replacement request by contacting Us via email at email@example.com. Once the replacement request has been raised, the following steps shall be followed
Customer is asked for "Reason for Return". Among others, the following are the leading reasons:
An intimation shall be provided to Vendor seeking either "approval" or "rejection" of the replacement request.
3. In case the Vendor accepts the replacement request, Customer shall be required to return the product to the Vendor and only after return of the product, Vendor shall be obliged to provide the replacement product to the Customer.
4. Incase Vendor rejects the replacement request, Customer can choose to raise a dispute by writing to firstname.lastname@example.org.
In case the Vendor doesn't have the product at all, Vendor can provide the refund to the Customer and Customer shall be obligated to accept the refund in lieu ofreplacement. All the product parameters shall be required to be complied with in cases of replacement.
If the Vendor doesn't respond to the Customer's replacement request, within three (3) days from the date of replacement request placed by the Customer, refund shall beprocessed in favour of Customer and Vendor shall be liable to refund amount paid to the Vendor.
All shipping and other replacement charges shall be borne and incurred by the Vendor.
Disputes (Resolutions) Policy
Generally, transactions are conducted smoothly on Ezwoks. However there may be some cases where both the Customers and Vendors may face issues. At Ezwoks, we have a Dispute Resolution process in order to resolve disputes between Customers and Vendors.
What is a 'dispute'?
A 'Dispute' can be defined as a disagreement between a Customer and a Vendor in connection with a transaction on the Website.
How does a 'dispute' occur in the Marketplace?
Disputes are filed as a result of a disagreement between the Customer and the Vendor. Disputes arise out of an issue that is raised by either party not being completely satisfied with the resolution of their complaint/issue.
It is important that before a Customer/Vendor raises a dispute, they should attempt to solve the issue. Please note that whenever a Customer raises a dispute, the Vendor's payment for that order is put on hold immediately until the issue is resolved.
How is a 'dispute' created?

In case the Vendor rejects the return request of the Customer, and Customer raises a dispute, then Ezwoks will try to mediate and resolve the dispute between both the parties. If the dispute is resolved in favour of the Customer, a refund is provided once the product is returned to the Vendor. If the dispute is settled in favour of theVendor, Customer is entitled to any refund.
Customer Protection Program
In case of a dispute where the Vendor is unable to provide a refund or a replacement, Ezwoks will actively work towards reaching a resolution.
The Customer Protection Program covers Customers who are unable to successfully resolve their dispute with the Vendor or are not satisfied the resolution provided by the Vendor.
The Customer can write to email@example.com if the issue with the Vendor is not resolved. Ezwoks's Customer Support team will look into the case to check for possible fraud and if the Customer has been black-listed/blocked from making purchases on the Website. Only after verifying these facts, a dispute can be registered.
In due course of resolution, Ezwoks's Customer Support Team will facilitate a conference call including the Vendor and the Customer.
When a dispute has been raised, Ezwoks may provide both the parties access to each others Display Names, contact details including email addresses and other details pertaining to the dispute. Customers and Vendors are subject to final consent from Ezwoks for settling the dispute.

Email Abuse & Threat Policy
Private communication, including email correspondence, is not regulated by Ezwoks. Ezwoks encourages its Users to be professional, courteous and respectful when communicating by email.
However, Ezwoks will investigate and can take action on certain types of unwanted emails that violate Ezwoks policies.
Threats of Bodily Harm - Ezwoks does not permit Users to send explicit threats of bodily harm.
